General terms and conditions of sale

These general terms and conditions of sale apply to all orders placed with HUAWEI AIR BLOWER (hereinafter referred to as "THE SELLER"), for all items offered on the website www.huawei-air-blower.eu by a natural or legal person (hereinafter referred to as "THE CUSTOMER"). Accordingly, the act of ordering a product offered for sale on the HUAWEI AIR BLOWER website implies full acceptance of these general terms and conditions of sale, which the Customer acknowledges having read prior to ordering.

Preamble

This website is operated by HUAWEI AIR BLOWER, a trading name of CONSULTIK SARL, having its registered office at 6 rue Louis Delplace, 93700 DRANCY, registered in the BOBIGNY Trade and Companies Register under number 803 897 628.

These general terms and conditions of sale apply to all orders placed with HUAWEI AIR BLOWER (hereinafter referred to as "THE SELLER"), for all items offered on the website www.huawei-air-blower.eu by a natural or legal person (hereinafter referred to as "THE CUSTOMER"). Accordingly, the act of ordering a product offered for sale on the HUAWEI AIR BLOWER website implies full acceptance of these general terms and conditions of sale, which the Customer acknowledges having read prior to ordering.

Clauses

Article 1: COMPLETENESS

These General Terms and Conditions express the entirety of the obligations of the parties. The Customer is therefore deemed to have accepted all the provisions of these General Terms and Conditions without reservation. HUAWEI AIR BLOWER undertakes to respect its role as a reseller in the context of these conditions.

Article 2: PURPOSE

The purpose of these General Terms and Conditions is to define the rights and obligations of the parties in the context of the online sale of articles offered by HUAWEI AIR BLOWER to the Customer, from the order to delivery, including payment and the use of services made available by HUAWEI AIR BLOWER.

Article 3: SCOPE OF APPLICATION

These General Terms and Conditions of Sale (GTCS) apply to all sales of Products, made through the websites and telephone conversations of HUAWEI AIR BLOWER, which form an integral part of the Contract between the Customer and the Seller. The Seller reserves the right to modify these GTC at any time by publishing a new version on its website. The GTC applicable at that time are those in force on the date of payment (or of the first payment in the case of multiple payments) of the order. These terms and conditions can be viewed on the HUAWEI AIR BLOWER website at the following address: www.huawei-air-blower.eu. The Seller also ensures that their acceptance is clear and unreserved by setting up a checkbox and a validation click. The Customer declares that he/she has read all of these General Terms and Conditions of Sale, and any Special Terms and Conditions of Sale relating to a product or service, and accepts them without restriction or reservation. The Customer acknowledges that he/she has received the necessary advice and information to ensure that the offer meets his/her needs. The Customer declares that he/she is legally capable of entering into a contract under French law or that he/she validly represents the individual or legal entity on whose behalf he/she is entering into a contract. In the absence of proof to the contrary, the information recorded by the Company constitutes proof of all transactions.

Article 4: ORDERING

ACCEPTANCE OF THE CONDITIONS BY THE CUSTOMER

These Terms and Conditions can be read directly on the www.huawei-air-blower.eu website. At the Customer's request, they may also be sent by e-mail.

The fact that the Customer ticks the "I accept the general terms and conditions of sale" box before making a secure payment constitutes irrevocable acceptance, which may only be challenged in the cases exhaustively provided for in these general terms and conditions of sale under the "right of withdrawal" paragraph.

By this act, the Customer acknowledges that he/she has read and understood these Terms and Conditions and accepts them.

Purchasing by telephone also implies acceptance of these Terms and Conditions, which the Customer acknowledges having read, understood and accepted in the above-mentioned conditions.

PLACING AN ORDER

The Customer can place an order with HUAWEI AIR BLOWER via the internet 24 hours a day, 7 days a week, or by telephone from Monday to Friday between 10.00 am and 6.00 pm.

The ordering process consists of 6 successive steps. Once the selection of products carried out, and the basket validated, the Customer must :

  • clearly identify the products selected on the www.huawei-air-blower.eu website;
  • indicate the quantities requested;
  • identify themselves either by entering their email address and password, which are strictly personal to them, or by entering all the information usually required for online registration;
  • clearly indicate the information required for delivery. This applies in particular to the precise delivery address as well as any restrictions on access to the delivery address (building, floor, key code, etc.);
  • indicate the delivery method chosen;
  • finally, indicate the chosen method of payment.

Once the payment method has been selected, the Customer must pay for the order via the secure interface, which will formally and definitively conclude the sales contract between the Customer and HUAWEI AIR BLOWER.

Any order implies acceptance of the prices and description of the products available for sale. Any dispute on this point will be dealt with in the context of a possible exchange and the guarantees mentioned below.

In all cases, the online provision of the bank card number and the final validation of the order by the Customer shall constitute proof of the order and payment of the sums for the products selected in the order. This validation constitutes signature and acceptance of all operations carried out on the www.huawei-air-blower.eu site.

ORDER CONFIRMATION

An e-mail is automatically sent to the Customer to confirm that the order has been placed, provided that the e-mail address given on the registration form is correct.

The Customer is responsible for checking the completeness and accuracy of the information provided to HUAWEI AIR BLOWER. HUAWEI AIR BLOWER cannot be held liable for any errors in the information provided and the consequences thereof in terms of delays or errors in delivery. In this context, all costs incurred for the return shipment will be borne by the Customer.

ORDER TRACKING

Customers can check the status of their order at any time by consulting the "My Account" section on the www.huawei-air-blower.eu website. This tracking enables the Customer to find out the status of their order, as well as the status of dispatch or delivery of their parcels. This delivery tracking is carried out in interface with the carriers' Internet tracking methods. HUAWEI AIR BLOWER can therefore not be held responsible for any unavailability or errors in the information provided by its carriers. Nevertheless, HUAWEI AIR BLOWER endeavours to make this information as clear as possible and to make the transport with its carriers as reliable as possible. The Customer can contact HUAWEI AIR BLOWER's customer service at any time in order to be informed about the progress of his/her order.

PROOF OF ORDER

The computerised registers, kept in the computer systems of HUAWEI AIR BLOWER under reasonable security conditions, will be considered as proof of the communications, orders and payments that have taken place between the parties.

Purchase orders and invoices will be archived on a reliable and durable medium that can be produced as proof.

HUAWEI AIR BLOWER reserves the right to refuse any Order from a Customer with whom a dispute exists or arises during the processing of an Order, in particular a payment dispute.

Article 5: PRIZES

The prices of products sold through the websites are indicated in Euros, excluding tax for items sold. For all products shipped outside the European Union and/or French overseas departments and territories, the price is automatically calculated exclusive of tax on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable in certain cases. These duties and sums are not the responsibility of the Seller. They shall be borne by the Buyer and are the Buyer's responsibility (declarations, payment to the competent authorities, etc.). The Seller invites the Buyer to obtain information on these aspects from the relevant local authorities. HUAWEI AIR BLOWER reserves the right to change its prices at any time in the future. Telecommunication costs for access to the Company's websites are to be borne by the Customer. Delivery costs may also be charged.

Article 6: PRODUCTS AND SERVICES

The essential characteristics of the goods and their respective prices are made available to the purchaser on the company's websites. The Customer certifies that he/she has received details of the delivery charges as well as the terms of payment, delivery and performance of the contract. The Vendor undertakes to honour the Customer's order within the limits of available stocks of Products only. The Vendor will inform the Customer if any Products are not available. This contractual information is presented in detail and in French. In accordance with French law, it is summarised and confirmed when the order is validated. The parties agree that the illustrations or photos of the products offered for sale have no contractual value. The period of validity of the offer of the Products as well as their prices is specified on the quotations of HUAWEI AIR BLOWER. Except in the case of special conditions, the rights granted hereunder are only granted to the natural person who signs the order (or the person who holds the email address provided).

Article 7: GUARANTEE

All HUAWEI AIR BLOWER products are guaranteed for 24 months against defects or manufacturing faults from the date of purchase. Wear and tear and damage due to negligence, abuse or failure to follow HUAWEI AIR BLOWER instructions are not covered by the warranty. HUAWEI AIR BLOWER shall not be liable for any personal injury or damage to property caused directly or indirectly by the product to a user, to personnel operating the product, or to the public. In the event of an incident on one of our products, a report must be sent to us with photos before any intervention or action is taken on the product.

Returns under warranty

To request a return, contact Huawei Air Blower Customer Service by e-mail at contact@huawei-france.com or by telephone on 01 76 54 50 94, who will inform the Customer of the procedures to follow. The return is at the Customer's risk. It is the Customer's responsibility to retain all proof of return. The cost of returning the goods is borne by the Customer, who is free to choose the method of shipment.

On receipt of the goods, HUAWEI AIR BLOWER will carry out a diagnosis of the fault found by the Customer. If it is an internal problem (inherent defect of the product): the replacement of the product as well as the costs of return to the Customer will be at the expense of HUAWEI AIR BLOWER.  In the case of a usage defect, the repair as well as the cost of returning the product to the Customer will be at the Customer's expense.

Article 8: PAYMENT TERMS

The Customer must pay the full price of the order, without discount and in cash on the date the order is validated. The amount to be paid is that indicated in the order summary (before validation of the order). In the case of payment by bank transfer and cheque, payment will be validated when the company's bank validates the order. The average time taken by the bank to validate a transfer is 2 to 5 working days, depending on the issuing country. The average time taken for a cheque to be validated by the bank is 20 days. This is indicated in the order confirmation sent to the Customer at the end of the order process. An invoice will also be sent to the Customer in accordance with the conditions specifically agreed with the Customer, and will remain available for download in the Customer Account.

In the event of payment by bank transfer or cheque, the Products remain the property of the Company until full payment of their price by the Customer.

Payment for the order is made by PAYPAL or by Bank Card in the case of cash payment. Huawei Air Blower does not collect any data relating to the Customer's bank accounts or electronic purse. The data linked to these two methods of payment (bank details and Paypal) are hosted by the intermediaries concerned (Paypal and banking establishment).

Only Town Councils are authorised to pay by administrative voucher. No goods may be dispatched without receipt of this administrative voucher.

Article 9: LATE PAYMENT

Credit may be granted to Professional Customers who request it from the company. In this case, any delay in payment in relation to the agreed payment date will automatically result in the application of late payment penalties equal to the interest rate applied by the European Central Bank to its most recent refinancing operation plus ten (10) percentage points, payable on the day following the payment date shown on the invoice if the sums due are paid after this date.

In addition, any Professional Customer who is late in making a payment is automatically liable to pay the Company a flat-rate recovery fee of forty (40) euros. If the recovery costs incurred exceed the amount of this fixed indemnity, the Company may request additional compensation on justification.

Article 10: RESOLUTION CLAUSE

If the purchaser fails to pay the outstanding sums, the sale will be automatically cancelled and HUAWEI AIR BLOWER may be entitled to claim damages.

Article 11: RESERVATION OF TITLE CLAUSE

HUAWEI AIR BLOWER retains ownership of the goods sold until full payment of the purchase price, in principal and in accessories. HUAWEI AIR BLOWER reserves the right to claim unpaid goods that have been sold as part of the insolvency proceedings if the purchaser is in receivership or liquidation.

Article 12: DELIVERY

Delivery charges

Delivery costs will be determined according to the characteristics (nature, volume, etc.) of the Products and the delivery method chosen. These costs are mentioned in the order summary and are payable by the Customer.

Terms of delivery

Products are delivered to the delivery address indicated when the order was placed. This delivery time does not take into account the time required to prepare the order.

Delivery times

When the Customer orders several products at the same time, these may have different delivery times, depending on the terms agreed at the time of sale. The Company will inform the Customer by any means of communication of any delays in delivery of which it becomes aware. The Customer may cancel the contract in accordance with the terms and conditions set out in Article L 138-2 of the French Consumer Code. The Vendor will then reimburse the product and the "outward" costs in accordance with Article L 138-3 of the French Consumer Code. The Seller provides a telephone contact point (cost of a local call from a landline) indicated in the order confirmation email in order to monitor the order.

However, the Company shall not be held liable for the consequences of a delay or suspension of delivery due to a case of force majeure as defined in the article "Liability - Force majeure" of these GTCS or events beyond the control of the Company or that of its suppliers or resulting from the fault or error of the Customer in providing the required information.

The Seller points out that when the Customer takes physical possession of the products, the risks of loss or damage to the products are transferred to the Customer. It is the Customer's responsibility to notify the carrier of any reservations regarding the product delivered. The Customer must open and check the contents of the parcel(s) delivered, both in terms of apparent conformity and the quantity ordered. To this end, the Customer will sign a delivery note.

In the event of an apparent anomaly (and in particular: damaged packaging, missing, damaged or broken Products), it is the Customer's responsibility to :

  • give a precise description of the condition of the Products on the delivery note (for example: "broken mirror", "wrong colour", "wrong size", etc.),
  • have any reservations co-signed by the carrier,
  • within 3 days of delivery, inform the Company, specifying the Customer's surname, first name and address as well as the number of the order concerned.

The Company will inform the Customer of its agreement or refusal to the request to return the Products as soon as possible. In the event of agreement, the cost of returning the Products will be borne by the Company.

In the absence of precise and justified reservations, the delivery will be considered to comply with the order, releasing the Company and the carrier from their obligations in respect of the delivery, without this constituting an obstacle to the subsequent application, where applicable, of conventional or legal guarantees.

In the event that delivery to the address indicated by the Customer is not possible (e.g. error in entering the delivery address, does not live at the address indicated, etc.), the Company will contact the Customer again to redefine the arrangements for making the order available.

Transfer of risk

The risks of loss, theft or deterioration of the Products are transferred to the Customer from the moment the Customer takes possession of the Products, upon delivery or collection from a sales outlet.

Article 13: FORCE MAJEURE

HUAWEI AIR BLOWER will not be liable if the non-performance or delay in the performance of any of its obligations under these terms and conditions is due to force majeure. In this respect, force majeure means any external, unforeseeable and irresistible event within the meaning of article 1148 of the French Civil Code.

Article 14: CLAIMS

Transport complaints

All claims relating to transport or its consequences must be made to HUAWEI AIR BLOWER and to the transport company in question by email to contact@huawei-france.com. Within 24 hours of receipt of goods and invoice in the case of breakage or damaged materials. In the event of non-delivery, the complaint must be made within seven (7) days.

Complaints about products outside the guarantee

Any complaint about the quality of products outside the guarantee offered by the Seller can only be processed if it has been sent in advance by e-mail to contact@huawei-france.com.

The return request must be made by contacting Huawei Air Blower Customer Service by e-mail at contact@huawei-france.comou or by telephone on 01 76 54 50 94, who will inform the Customer of the procedures to follow. The return is at the Customer's risk. It is the Customer's responsibility to retain all proof of return. The return costs are borne by the Customer, who is free to choose the method of shipment.

On receipt of the goods, HUAWEI AIR BLOWER will carry out a diagnosis of the fault found by the Customer and will send the Customer a replacement/repair estimate for validation. The return/shipping costs as well as the repair/replacement costs are to be paid by the Customer.

Article 15: COURT OF JURISDICTION

Any dispute relating to the interpretation and performance of these general terms and conditions of sale shall be governed by French law. Failing amicable resolution, the dispute will be brought before the Commercial Court of Bobigny (93).

Article 16: INTELLECTUAL PROPERTY

Trademarks, domain names, products, software, images, videos, texts and, more generally, any information subject to intellectual property rights are and remain the exclusive property of the seller. No transfer of intellectual property rights is made through these GTC. Any total or partial reproduction, modification or use of these goods for any reason whatsoever is strictly prohibited.

Article 17: PROTECTION OF PERSONAL DATA

In accordance with the French Data Protection Act (Loi Informatique et Libertés) of 6 January 1978, you have the right to query, access, modify, oppose and rectify any personal data concerning you. By accepting these general terms and conditions of sale, you consent to us collecting and using this data for the purposes of this contract. By entering your email address on one of the sites of our network, you will receive emails containing information and promotional offers concerning products published by HUAWEI AIR BLOWER. You can unsubscribe at any time.
